As chair, he had to push through a lot Bush II nominees for the sake of partisanship. Now, as ranking member, he would have to lead the resistance to perfectly acceptable, fully qualified Obama nominations for the next 4 - 8 years or face reprisal from the new de-facto leader of the GOP. Nina Totenberg reports that the Souter resignation was revealed to insiders about a month ago. Put them all together, consider his age and health, and reflect on the Powell "china shop" principle.
